First check if the check you or your company sent for H-1 fees got cashed , if so see behind the check ( normally banks post scanned copy of check ) the Receipt number will be written behind the check ..hope this helps

Hi

first labor approved in may 2006 under EB3
140 was approved in 2007

Since I already had masters before I joined the company
EB2 labor applied and received approval in Jan 2011

My attorney applied for 140 porting but received priority date as Jan 2011 instead of may 2006. My attorney says immigrations has made a mistake, attorney contacted them and received a reference number basically asking attorney to call back on Jun 1st. I'm concerned on what went wrong and what could be the worst case scenario. How much time are talking about here.

Any information will be greatly appreciated.

My wife is laid off and her company is going to cancel her H1B soon. h1 petition is getting expired on Oct,2009. now I am going to apply for COS to h4. If she wants get H1 status after one year can she use the same petition for H1 transfer?. or she has to apply a new H1?.
Can you please help me.

She has to apply for COS again from H4 to H1. It will not be subjected to the cap if she had H1 within last six years at the tme applying COS to H1

Hi,

I had a question regarding the july bulletin where it was mentioned that Old fees is entertained for employment based petetions while family based it would be new fees for I485.

Mine was applied by my company on July 2nd with old fees and Spouse's was applied on August 3rd with old fee and was rejected! I-140 was approved on August 8th and applied in March 2007!

Did they confuse with family based and rejected for fees?

Spouse should also be employment based right!

Can somebody answer my question or suggest any other possibilities for rejection?

My husband and I are in a big Dilemma whether to apply for EAD or AP? In the lawyer's note,it says that anyone who is I-140 Beneficiary will not be able to use EAD and AP. Is it true?

We are on our 3 years H1/H4 using I-140 benefits only. What should we do?

Please guide us.

We still have 3 years remaining. Problem - We both have no visa stamping after we got our extentions which why AP is required at this point?

Are there any travel restrictions after we file I-1485 with AP or WITHOUT AP.

Please highlight. Will be very useful for us.
