    We are applying for my husband's H4 extension now. ( My new H1b extension was approved only till Sept 25, 2009 based on the SOW( client contract) rather than 3 years)So he would be able to get his extention same as me Sept 25, 2009.

    We have also applied for my husband's H1b this year. Hopefully, if his H1b is approved

    1. Does he has to go outside US to get his visa stamped to start working from Oct 1, as there is no status for him from Sept 26 through Sept 30 ( 5 days)

    2. If we apply for his H4 extension along with my H1b extension during early Sept and he will remain in status as the Case will be pending, Does it allow him to start working on H1b without needing to stamp?

    Is it possible to obtain a Greencard from L1B status? If yes, how long does this process typically take? My understanding is it is possible and definitely easier/shorter than being on H1?

    Yes, it is possible to obtain a Green card from L1B. However, you will have to undergo the Labor certification process (PERM application). Time wise there will not be a difference whether you apply under H1-B or L1B. It is only foreign nationals who are managers and executives on L1A status are eligible to apply for the green card without the labor certification.

    My sponsoring company received an Audit Letter from INS today. Is this the norm in today's scenerio when one applies for labor for a new Green card process?

    How alarming is it? What are its effects on Labor application?

    I recently got my H1 3 yr extension based on I-140 approval, I want to change my job to company B but my employer Company A says that he will have to revoke the I-140(as per company attorneys), Will this affect my H1 extension(as in will I be out of status?) and can I retain my PD?

    Also does anyone know a good lawyer I can consult over the phone?

    Hello Everyone great community here and very useful information.

    Received the email from Cris I-140 approved today.

    I just would like to know how long it should generally take for I-485 approval. Now visa's were current when I file I485. What is the status now do I have to wait for visa's to be current again? Sorry for lack of knowledge GC process takes so long sometimes its good to just forget about it :)

    Here is the data:

    H1 8th year still current :)
    EAD 07/07
    AP 07/07
    PD AUG 2003 EB3 Retro
    I-140 Approved Today
    FP 10/07
    I-485 pending since 07/07 ???????????????????
    AC21 Invoked 04/08

    Company A filed my I-140 and it got approved, however I have not been provided with copy of the approval notice. I don't have the receipt number either. In this case, is it possible to obtain the copy of I-140 thru FOIA (Freedom of Information Act)?

    My wife couldn't get Xray on a failed TB skin test, because she was pregnant at the time we filed our 485. Our priority date will be current in August.

    Should we wait for a RFE on her medicals? Or is it possible to go ahead and do it, and send an update to USCIS?

    Given a situation, one way to dust a file is to send the medical with a cover letter.

    Hi ,
    Can one extend the H1B beyond 6 years based on the I-140 approval even after I-485 DENIAL ??

    I JUST WANTED TO COVER SOME WORST CASE SCENARIOS BEFORE MAKING SOME DECISIONS.
